Since he is a presidental candidate I think these could be considered
political campaign ads.

Your reasoning is suspect since he hasn't announced (which is MORE than
just a technicality, since formally filing opens you up to a source of
revenue and fundraising and other legalities), but even if we accept
your premise and consider them political campaign ads, I ask, SO WHAT?

It's in no way shape or form a technicality. If he hasn't announced,
he's not running, and his ads aren't campaign ads.

Other candidates perhaps could cry foul on this but so far they haven't
that I know of.

It's obviously the opening salvo in his campaign, but where do you draw
the line? He is a current a US Senator, so speaking out is part of his job.
